Terms and Conditions for E-Commerce Transactions

Welcome to Stalotto's online store. These Terms and Conditions ("Terms") govern your use of our website and the purchase of any goods or services ("Products") from Stalotto ("we," "us," "our"). Please read these Terms carefully before using our website or making any purchase. By accessing or using our website and purchasing Products, you agree to be bound by these Terms.

Note: These Terms do not apply to any competitions or prize draws offered by Stalotto. Competitions are governed by separate Competition Terms & Conditions available on our website.

1.1. By using our website and purchasing any Products, you accept and agree to be bound by these Terms, our Privacy Policy, and any additional terms and conditions referenced herein or available by hyperlink.

1.2. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. Definitions

  • "Customer," "you," or "your" refers to the individual accessing or using our website and purchasing Products.
  • "Products" refers to any goods or services, including physical goods and event tickets, offered for sale on our website.
  • "Events" refers to any events organized or promoted by Stalotto for which tickets are sold through our website.

3. Eligibility

3.1. To place an order with Stalotto, you must be at least 18 years old and legally capable of entering into binding contracts.

3.2. By placing an order, you represent and warrant that you meet these eligibility requirements.

4. Orders and Contract Formation

4.1. Product Description: We strive to ensure that all Product descriptions, images, and prices are accurate. However, errors may occur. If we discover an error in the availability, description, or price of any Product you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order or cancel it.

4.2. Placing an Order: To place an order, you must follow the ordering procedures set out on our website. All orders are subject to acceptance by us.

4.3. Order Confirmation: After placing an order, you will receive an email acknowledging receipt of your order. This email is only an acknowledgment and does not constitute acceptance of your order.

4.4. Contract Formation: A contract between you and Stalotto for the purchase of Products will only be formed when we send you a confirmation email stating that the Products have been dispatched.

4.5. Right to Reject: We reserve the right to refuse or cancel any order for any reason, including but not limited to Product availability, errors in Product information or pricing, or if we suspect fraudulent activity.

5. Prices and Payment

5.1. Pricing: All prices are listed in British Pounds Sterling (£) and include VAT where applicable. Delivery charges are not included in the Product prices and will be added at checkout.

5.2. Price Changes: Prices are subject to change without notice. Such changes will not affect orders for which you have already received a dispatch confirmation.

5.3. Payment Methods: We accept various payment methods as indicated on our website. By providing payment information, you represent and warrant that you are authorized to use the designated payment method.

5.4. Payment Processing: Payment is due at the time your order is placed. If we are unable to collect payment, we may delay or cancel your order.

6. Delivery and Ownership

6.1. Delivery Locations: We offer delivery within the United Kingdom. Delivery to other locations may be available and will be indicated on our website.

6.2. Delivery Times: Estimated delivery times are provided as guidelines and are not guaranteed. We will not be liable for any delays in delivery caused by events outside our control.

6.3. Ownership and Risk: Ownership of the Products will pass to you when we have received full payment. Risk of loss or damage to the Products passes to you upon delivery.

7. Cancellation and Returns

7.1. Consumer Rights

7.1.1. Right to Cancel: If you are a consumer, you have the right to cancel your order for most Products within 14 days without giving any reason, in accordance with the Consumer Contracts Regulations 2013.

7.1.2. Cancellation Period: The cancellation period will expire after 14 days from the day on which you receive the Products.

7.1.3. How to Cancel: To exercise the right to cancel, you must inform us of your decision by a clear statement (e.g., a letter sent by post or email). You may use the model cancellation form provided at the end of these Terms but are not required to do so.

7.2. Effects of Cancellation

7.2.1. Refunds: If you cancel the contract, we will reimburse all payments received from you, including the costs of delivery (except for additional costs arising if you chose a delivery method other than the least expensive standard delivery offered by us).

7.2.2. Deduction for Diminished Value: We may deduct from the refund for loss in value of any Products supplied if the loss is the result of unnecessary handling by you.

7.2.3. Reimbursement Timing: We will make the reimbursement without undue delay, and not later than:

  • 14 days after the day we receive the returned Products, or
  • (if earlier) 14 days after the day you provide evidence that you have returned the Products.

7.2.4. Reimbursement Method: We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise.

7.3. Return of Products

7.3.1. Return Address: You must send back the Products to us at the address provided in our return instructions without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation.

7.3.2. Costs of Return: You will bear the direct cost of returning the Products.

7.4. Exemptions

7.4.1. Non-Cancellable Goods: The right to cancel does not apply to:

  • Perishable goods.
  • Sealed goods that are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery.
  • Custom-made or personalized items.
  • Event tickets (see Section 8).

8. Events and Ticket Sales

8.1. Ticket Purchase: When you purchase tickets for Events through our website, you agree to be bound by these Terms and any additional terms specific to the Event.

8.2. Refunds and Exchanges: All ticket sales are final. Refunds or exchanges will only be made if the Event is canceled or rescheduled.

8.3. Event Changes: We reserve the right to make alterations to the advertised Event program or venue where necessary.

8.4. Event Cancellation: If an Event is canceled, we will offer a refund of the ticket price. We will not be liable for any additional expenses incurred (e.g., travel or accommodation costs).

8.5. Admission: Admission to Events is subject to any terms, conditions, or rules imposed by the Event venue or organizers.

8.6. Resale Prohibition: Tickets purchased from us may not be resold or transferred for commercial gain.

9. Event Deposits

9.1. Deposit Requirement: For certain Events, we may require a deposit to secure your booking. The amount of the deposit and the applicable Event will be specified at the time of booking.

9.2. Refund Policy: Deposits are refundable if you cancel your booking within 14 days from the date of payment ("Cooling-Off Period"). After the Cooling-Off Period, deposits are non-refundable.

9.3. Cancellation by You: If you cancel your booking after the Cooling-Off Period, you will forfeit the deposit paid. Cancellations must be communicated to us in writing via email or postal mail.

9.4. Changes to Bookings: Requests to change the date or details of your booking are subject to availability and our discretion. Additional charges may apply.

9.5. Non-Transferable: Deposits are non-transferable to other Events or Products unless agreed upon by us in writing.

9.6. Cancellation by Us: If we cancel the Event for any reason other than due to your breach of these Terms, we will refund your deposit in full.

10. Limitation of Liability

10.1. No Exclusion of Liability: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

10.2. Exclusion of Liability: Subject to Clause 10.1, we will not be liable for:

  • Any indirect, special, or consequential losses.
  • Loss of income, revenue, business, profits, or contracts.
  • Loss of anticipated savings.
  • Loss of data.

10.3. Total Liability: Our total liability to you in respect of all other losses arising under or in connection with the contract shall not exceed the total amount paid by you for the Products.

10.4. Events Outside Our Control: We will not be liable for any failure to perform or delay in performance of any of our obligations caused by events outside our reasonable control.

11. Intellectual Property Rights

11.1. Ownership: All intellectual property rights in our website and the material published on it are owned by us or our licensors.

11.2. Permitted Use: You may use the content of our website for your personal, non-commercial use.

11.3. Prohibited Use: You must not reproduce, duplicate, copy, sell, or otherwise exploit our website or any portion of it for any commercial purpose without our express written consent.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.

16. Entire Agreement

These Terms and any policies or operating rules posted by us on the website constitute the entire agreement and understanding between you and us.
